General terms and conditions for Ginger & Ginger BV
A1. Applicability of general terms and conditions
1.1 All deliveries of GINGER & GINGER BV are subject to current terms and conditions.
1.2. The failure of one of the parties to exercise any of the rights granted by the present conditions does not imply that such party waives the right to invoke such right in the future.
2. DELIVERY
2.1. Unless otherwise stipulated, deliveries are made carriage paid to the requested delivery address. The customer will make the necessary arrangements to receive the ordered products. GINGER & GINGER BV will not be liable for any damage or loss, resulting from the impossibility or lateness of delivery due to circumstances beyond its control, e.g. weather conditions, strike, engine trouble, supply strike.
2.2. A receipt document will be signed by the customer for each delivery.
2.3. The customer shall notify GINGER & GINGER BV in writing as soon as possible after delivery regarding possible defects in the delivered products. In the absence of any written notification within twenty-four hours after delivery, the Customer will be deemed to have accepted the products and they cannot be replaced or reimbursed.
3. Product
3.1. GINGER & GINGER BV does not guarantee any particular health or dietary requirements or purposes of the supplied products. While the website and other information made available to the customer by GINGER & GINGER BV provides general information regarding health and nutrition, this information can in no way be equated with medical advice and is not tailored to the particular needs of each individual end user.
3.2 Certain products of GINGER & GINGER BV may not be suitable for pregnant women or persons under medication or with a medical condition, so that prior advice from the attending physician is recommended.
3.3. Delivered products are produced in a kitchen in which nuts may be present. By taking note of the present conditions of GINGER & GINGER BV, the customer acknowledges that GINGER & GINGER BV cannot be held liable for any reaction of the end user to nuts or other ingredients.
4. Prices
4.1 The prices of the products and services offered are indicated in euros, including VAT and excluding transport costs and/or other taxes or levies, unless otherwise stated or agreed in writing.
4.2. GINGER & GINGER BV is entitled to update the above prices to reflect any increase in the cost of the products.
5. Liability
GINGER & GINGER BV will never be liable for any damages suffered by the Customer in connection with the products or material it has delivered, unless it is a matter of fraud or willful intent on the part of GINGER & GINGER BV, in which case the maximum damages due by GINGER & GINGER BV will never exceed the invoice value of the product or material it has delivered. In any case, GINGER & GINGER BV will never be liable for consequential damages and therefore, GINGER & GINGER BV will not be obliged to compensate, inter alia, business interruption, loss of profit, damages resulting from claims of third parties against the customer.
6. Intellectual property
6.1.The content of the website and app (including but not limited to the text, images and information) of GINGER & GINGER BV is protected by copyright and other applicable intellectual property rights. No content of the website or materials may be reproduced, modified, copied or distributed or used for commercial purposes without the express written consent of GINGER & GINGER BV.
7. Applicable law - competent court
The contractual relationship between GINGER & GINGER BV and the customer is governed by Belgian law. In case of disputes only the courts of the district of Antwerp are competent.
