Terms and Conditions

1. APPLICABILITY OF GENERAL TERMS

1.1 All deliveries by GINGER & GINGER BV are subject to these current terms and conditions.

1.2 The fact that one of the parties does not exercise one of the rights granted by these terms and conditions does not imply that this party waives the right to invoke such right in the future.

2. DELIVERY

2.1 Unless otherwise agreed, deliveries are made free at the requested delivery address. The customer shall make the necessary arrangements to receive the ordered products. GINGER & GINGER BV shall not be liable for any damage or loss resulting from the impossibility or delay of delivery due to circumstances beyond its control, such as weather conditions, strikes, vehicle breakdowns, or supply strikes.

2.2 The customer shall sign a receipt document upon each delivery.

2.3 The customer shall promptly notify GINGER & GINGER BV in writing of any defects in the delivered products. In the absence of any written notification within twenty-four hours after delivery, the customer shall be deemed to have accepted the products, and they cannot be replaced or refunded.

3. PRODUCT

3.1 GINGER & GINGER BV does not guarantee any particular health or dietary requirements or goals of the delivered products. While the website and other information provided by GINGER & GINGER BV to the customer provide general information regarding health and nutrition, this information cannot be equated with medical advice and is not tailored to the specific needs of each individual end-user.

3.2 Certain products of GINGER & GINGER BV may not be suitable for pregnant women or individuals under medication or with a medical condition, so prior advice from the attending physician is advisable.

3.3 The delivered products are produced in a kitchen where nuts may be present. By acknowledging these terms and conditions of GINGER & GINGER BV, the customer acknowledges that GINGER & GINGER BV cannot be held liable for any reaction of the end-user to nuts or other ingredients.

4. PRICES

4.1 The prices of the offered products and services are indicated in euros, including VAT and excluding transportation costs and/or other taxes or levies, unless otherwise stated or agreed upon in writing.

4.2 GINGER & GINGER BV is entitled to update the above-mentioned prices to reflect any increase in the costs of the products.

5. LIABILITY

GINGER & GINGER BV is never liable for any damage to the customer in connection with the products or materials delivered by it, unless there is fraud or willful misconduct on the part of GINGER & GINGER BV, in which case the maximum compensation payable by GINGER & GINGER BV shall never exceed the invoice value of the damaging product or material delivered by it. In any case, GINGER & GINGER BV is never liable for consequential damages and therefore not obliged to compensate for, among other things, business interruption, loss of profits, or damages resulting from claims by third parties against the customer.

6. INTELLECTUAL PROPERTY

6.1 The content of the website and app (including but not limited to text, images, and information) of GINGER & GINGER BV is protected by copyright and other applicable intellectual property rights. The content of the website or the materials may not be reproduced, modified, copied, or distributed or used for commercial purposes without the express written consent of GINGER & GINGER BV.

7. APPLICABLE LAW - JURISDICTION

The contractual relationship between GINGER & GINGER BV and the customer is governed by Belgian law. In case of dispute, only the courts of the Antwerp district shall have jurisdiction.
